New California law allows sex offenders to be removed from registry
A bill signed by former California Governor Jerry Brown allows the vast majority of registered sex offenders in the state to petition for registration removal. Some estimates say 9-out-of-10 registered sex offenders will be eligible. Before the bill – SB384 – people on the registry had to register for life, even if they were convicted of a nonviolent sex crime categorized as a misdemeanor.
Beginning in 2021, most sex offenders in California can petition the court to take them off public and police registries. The caveat is they must wait 10 to 20 years after completing any sentencing requirements to become eligible to file a petition. Committing another felony, violent crime, or sex crime in those 10 to 20 years will also make a petitioner ineligible for removal from the registry.
The bill was signed by former Governor Brown after a lengthy back-and-forth with California’s lawmakers. Many were afraid the change would be too lenient. However, there is no strong evidence to suggest that people would re-offend if they removed from the list, which currently has more than 100,000 registered sex offenders on it. Following this logic, the bill was passed and signed.
